In a major corporate governance development, Tata Trusts has taken a preliminary legal view that its existing permanent trustees may not need fresh reappointment for fixed terms, despite the Maharashtra government’s recent ordinance on trustee tenure.

According to people familiar with the matter, the Trusts’ legal advisors believe the ordinance does not clearly apply retrospectively, meaning current trustees could continue in their existing roles without immediate structural changes. This may help Tata Trusts avoid a sudden reshuffle in one of India’s most influential charitable institutions.

The issue is significant because Tata Trusts controls around 66% of Tata Sons, the holding company of the Tata Group. Any governance-related uncertainty at the Trusts level is closely watched by markets for its potential impact on board decisions and long-term strategic continuity.

Legal experts, however, suggest that further clarity from regulators or courts may still be required, which means the governance debate around trustee appointments is far from over.
